Media Release Form
This agreement (the “Release”) confirms the terms on which you agree to allow Canadian Women & Sport to use, for the purposes set out below, image(s) featuring you (if over 18) or your child (if under 18, of whom you confirm you are the parent or guardian).
SPECIFIC PURPOSES OF THE IMAGE (“Specified Purposes”)
Any commercial or non-commercial purposes in all and any media including without limitation in Canadian Women & Sport’s printed publications, presentations, promotional material, in the advertising of CANADIAN WOMEN & SPORT’s goods or services or on CANADIAN WOMEN & SPORT’s websites and social media platforms.
WHAT I WILL RECEIVE?
The individual in the Image acknowledges that there will be no payment made to them by CANADIAN WOMEN & SPORT for the Image or the rights of CANADIAN WOMEN & SPORT to use the Image as detailed below.
CONDITIONS
1 Canadian Women & Sport licenses rights or provides services to, and/or any company which is, in relation to any such company, its parent undertaking or subsidiary) is sponsoring, producing, directing, organising, running or paying for the Event, in which I wish to take part.
2 I understand and agree that CANADIAN WOMEN & SPORT may photograph and/or film me during my participation and attendance at the Event and may use the Image for the Specified Purposes.
3 I warrant that: (i) I do not need to obtain permission from or pay any third party in connection with the rights granted in this Release; (ii) I am entitled to grant the rights set out in this Release; and (iii) CANADIAN WOMEN & SPORT does not need to obtain permission from or pay any third party in connection with the rights granted in this Release.
4 I grant CANADIAN WOMEN & SPORT exclusive permission to use the Image throughout the world for the Specified Purposes, including permission to publish the Image on the internet, in its original format, edited, or altered in any way that CANADIAN WOMEN & SPORT deems appropriate.
5 I do not object to CANADIAN WOMEN & SPORT storing copies of the Image for as long as necessary to fulfil the Specified Purposes or to CANADIAN WOMEN & SPORT storing my contact details on its database in case it needs to contact me.
6 For the purposes of this Release, the data controller is the CANADIAN WOMEN & SPORT entity referenced above in the CANADIAN WOMEN & SPORT definition. I agree and acknowledge that by ticking the box below I give my consent, for the purposes of applicable data protection legislation, for CANADIAN WOMEN & SPORT to process the personal data provided in relation to the Image or as part of the rights granted in this Release form, including my image and contact details. CANADIAN WOMEN & SPORT will process any such personal data in accordance with applicable data protection legislation and the CANADIAN WOMEN & SPORT Privacy Policy in force from time to time, which is available at Privacy Policy. 7 This Release constitutes the entire agreement between us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us, whether written or oral, relating to its subject matter. This Release cannot be altered or modified. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in this Release.
8 If any wording in this Release is held, in part or in full, to be invalid or unenforceable for any reason, the validity of the remaining clauses of this Release shall not be affected, and they shall continue to be valid and enforceable. The invalid and unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision.
9 This Release and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the jurisdiction of the signatory’s residence.
DATA PROTECTION NOTICE
For the purposes of this Release, the data controller is the CANADIAN WOMEN & SPORT entity referenced above. In completing the Image Release Form and allowing CANADIAN WOMEN & SPORT to use the Image, you will provide CANADIAN WOMEN & SPORT with certain personal data, including your image, contact details and personal details. You understand and acknowledge that by completing the Image Release Form and ticking the box to state that you agree with this Data Protection Notice, you give consent for CANADIAN WOMEN & SPORT to process your personal data. CANADIAN WOMEN & SPORT processes the personal data to use your image across its platforms, as well as to handle queries and other follow-up matters in relation to the image.
CANADIAN WOMEN & SPORT may share your personal data with third parties to process the data on CANADIAN WOMEN & SPORT’s behalf. When using third parties to process data, CANADIAN WOMEN & SPORT will require the third parties to implement appropriate measures to protect your personal data.
CANADIAN WOMEN & SPORT will always process your personal data in accordance with applicable data protection legislation.
